Scope of validity

The territorial validity of a trademark determines the territory where its protection is valid. There is no reason to rush this seemingly simple decision and it is better to think it through completely.

Although it is possible to extend the territorial validity of a trademark in the future, it is associated with other administrative processes and may become more expensive. If, for example, you do business in an area that is geographically and in terms of business authorisation bound to Slovak territory, a National Trademark with territorial validity in Slovakia will suffice.

Conversely, if you offer or plan to place goods and services on cross-border markets, it pays to directly register a European trademark with territorial validity in all countries of the European Union, or an international trademark.

Specify a type of trademark

In this step you need to consider what kind of characters or sounds will comprise your trademark. You have a choice of several standardised variants, some of which contain combined options. The trademark may consist of words, drawings, letters, numbers, colours, the shape or packaging of goods, a soundtrack or a multimedia recording. Choose a variant for your trademark that can differentiate your goods and services from the competition as concisely as possible.

Word mark

This mark consists of words, letters, numbers, other standard typographic characters, or a combination thereof that can be written.

Visual mark

This mark consists of non-standard characters, stylisation or appearance, graphic property or colour. Also included are marks composed exclusively of figurative elements or figurative marks which contain verbal elements. Accepted format: JPEG, 300 dpi, max. 2 MB

Audio mark

An audio file that reproduces sound or accurately expresses sound through music notation. Accepted formats: MP3, max. 2 MB

Colour mark

A trademark consisting of a single colour (without outlines), a combination of colours (without outlines) or consisting of a design from a set of elements which are repeated regularly. Accepted format: JPEG, 300 dpi, max. 2 MB

Multimedia content

Such content is a combination of audio and visuals or includes them. Accepted file formats: MP4, max. 20 MB

Spatial 3D mark

A three-dimensional trademark is comprised of a three-dimensional shape or includes a three-dimensional shape or combines it with word elements. Accepted formats: JPEG, OBJ, STL, X3D

Hologram mark

This mark contains elements with holographic properties. Accepted formats: JPEG 300 dpi, max. 2 MB or MP4, max. 20 MB

Positioning mark

This mark is based on the specific way in which a mark is positioned on or attached to a product. Accepted formats: JPEG, 300 dpi, max. 2 MB
